Terms of Service
By using Sports Manager PRO ("Game"), you accept these Terms of Service in their entirety.
1. General Provisions
- The Game is operated by appcadabra sp. z o.o., registered in Gdynia (81-365), ul. Stefana Batorego 23/7, Poland. KRS: 0000887352, share capital: PLN 75,000, REGON: 388357023, NIP: 5862366262. Contact: support@sportsmanagerpro.com.
- The Game is an electronic service within the meaning of applicable law on the provision of electronic services.
- The Game is intended exclusively for adults (18 years of age and older).
- These Terms govern the use of the Game, including rules regarding the user account, payments, Operator liability, and the procedure for filing and resolving complaints.
- All player names and athlete data appearing in the Game are fictitious and generated randomly for the purposes of the Game. Any resemblance to real persons is purely coincidental.
2. User Account
- Creating an account requires a valid email address and password. A service agreement is concluded at the moment of account creation.
- The Player is responsible for maintaining the confidentiality of their login credentials and all actions performed on their Account.
- The Player may delete their account at any time through the account settings. Account deletion is irreversible.
- Upon account deletion, the Player's personal data is anonymized. The club is not removed but is marked as inactive.
- All purchased credits, active subscription plans, and other digital goods are forfeited upon account deletion.
- The Operator may suspend or delete an account in the event of a violation of these Terms or the Game Rules.
- If more than one person uses the Game from the same IP address or device, the user is required to notify the Operator before creating an additional account. The Operator may approve or refuse the creation of an additional account.
3. Service Character and Availability
- The Game is an online service provided on a continuous basis.
- The Operator does not guarantee uninterrupted availability of the Game, nor the preservation of specific progress, rankings, or the value of virtual goods.
- The Operator may introduce changes to the mechanics, balance, economy, features, or content of the Game.
- The Operator may perform scheduled maintenance that temporarily limits access.
4. Payments and Digital Goods
- The Game offers digital goods: credits (available in packages) and subscription plans (Freemium, Premium, Platinum).
- Digital goods do not constitute the Player's property in a legal sense; they represent an entitlement to use Game features.
- Prices are displayed before purchase. Payments are processed by external payment operators (Paynow / Tpay).
- By purchasing digital content and consenting to immediate delivery, the Player acknowledges the loss of the right of withdrawal in accordance with applicable consumer protection law regarding digital content.
- In the event of sanctions or account closure, purchased credits and active plans are not refunded.
- The Operator may revoke digital goods obtained in violation of these Terms.
5. Permitted Use
- The Player agrees to use the Game in accordance with applicable law, these Terms, and the Game Rules.
- Prohibited activities include: using bots, macros, and automation tools; exploiting system errors; interfering with game code; manipulating network traffic; and actions disrupting server operation.
- The Operator may apply protective measures including abuse monitoring, blocks, restrictions, and reversal of unfairly obtained benefits.
- Detailed rules of conduct are defined in the Game Rules.
6. Intellectual Property
- All rights to the Game and its elements belong to the Operator.
- The Player receives a non-exclusive, revocable license to use the Game solely for personal use.
7. Liability
- The Operator is liable only for damages caused intentionally.
- The Operator is not liable for: interruptions due to force majeure, loss of progress due to technical failures, or actions of third parties.
- The Operator's liability toward consumers is not excluded to the extent that such exclusion is prohibited by law.
8. Complaints
- Complaints should be directed to: support@sportsmanagerpro.com.
- A complaint should include a description of the issue and account identification data.
- A response is provided within 14 days.
9. Changes to Terms
- The Operator reserves the right to amend these Terms at any time for valid legal, technical, or organizational reasons.
- Users will be notified of changes to these Terms in advance through a message in the Game or on the official website.
- Changes take effect on the date specified in the notification, no earlier than 7 days from the announcement, unless applicable law or security considerations require immediate implementation.
- Continued use of the Game after changes have been introduced constitutes acceptance of those changes.
10. Governing Law
- These Terms are governed by the laws of Poland.
